Terms and Conditions

1. General

The terms below apply to all contracts, deliveries and other services made through this website between Leopold Pöll KG hereinafter referred to as LEPOSA, and the customer. General terms and conditions are valid in the version at the time of the order. LEPOSA only recognizes deviating conditions of the customer if we have expressly agreed to their validity in writing.

2. Order

With your order you are submitting a binding offer to LEPOSA to conclude a contract.

The offer can be made via E-Mail or with confirming the shopping cart in our online shop. After the order has been placed in the online shop, the customer automatically receives an email that documents the offer (order) he has submitted. This email only confirms that we have received the order; a contract is not yet concluded. However, a purchase contract is only concluded when the goods ordered have been shipped. LEPOSA reserves the right not to accept the offer if an item is not available, if you have wrongfully not paid bills for earlier deliveries, if your credit card check is not successful, or if other justified doubts about your creditworthiness exist. If NEW ONE cannot execute an order, NEW ONE will notify you of this as quickly as possible.

When ordering via our online shop, the ordering process comprises the following steps: In the first step, you select the goods you want. In the second step, enter your customer data including the billing address and, if applicable, a different delivery address, and at the same time select your payment method. By clicking the order button you confirm your purchase. We will send you an order confirmation with all order data to the email address you provided. We save the contract data of your order.

The merchandise pictured on the website was partially digitally photographed. There may be minor differences between the photographs and the actual appearance of the merchandise. Such differences do not constitute a defect in the ordered merchandise.

3. Retention of Title

The merchandise remains property of Leopold Pöll KG until payment in full.

4. Delivery, Prices, Shipping Costs

We deliver to the EU and Switzerland. Shipping is handled by Österreichische Post AG.

Standard shipping within Austria costs € 5.90 – within Germany it costs € 7.90. Delivery is free for shopping cart values of € 100 or more. Standard shipping within the EU costs € 9,90; to Switzerland €14,90. In this case delivery is free for shopping cart values of € 200 / CHF 200 or more

Please be aware that if your retained value of products drops under the free delivery limit of € 100 / € 200 / CHF 200 shipping costs will be invoiced. Delivery time is up to 1 week after we have received your payment. If delivered items have obvious material or manufacturer defects, including damages in transit, please report such defects to us immediately: info@leposa.at.

The delivery time is extended appropriately in the event of circumstances impairing delivery due to force majeure. Force majeure includes strikes, lockouts, official interventions, energy and raw material shortages, through no fault of our own transport bottlenecks, through no fault of our own operational hindrances, for example due to fire, water and machine damage, and all other hindrances that, from an objective point of view, were not culpably caused by us. We will inform you of the beginning and end of such obstacles immediately. If the impediment to performance in the aforementioned cases lasts for a period of more than 4 weeks after the originally applicable delivery times, you are entitled to withdraw from the contract. Further claims, especially for compensation do not exist.

All stated prices are in Euro for the EU and CHF for Switzerland, and are understood to be inclusive of statutory VAT.

For shipping to Switzerland, there are additional customs costs on the order amount (including shipping costs) at the expense of the customer. These are charged and settled separately upon import.

5. Payment

For each order you are selecting the payment method. You have the option between: We offer the following payment methods:

• Bank transfer
  After you have selected the payment method bank transfer and have completed the order, you will receive our bank details in the order confirmation. The bank transfer must be carried out directly at your bank. Only when the amount has been received will the goods be sent.

• PayPal
  You pay directly through your PayPal account. After submitting your order, you will be forwarded to PayPal and where you will approve the order value. We will deliver the order as soon as our PayPal account has confirmed your authorization.

• Credit Card
  You pay directly with your credit card when you place the order. If you pay by credit card, your account will be debited when the order is completed. Only upon receipt of the amount we will release the shipment of the goods.

We have a SSL (Secure Socket Layer) connection through which the payment will be processed. After the bill amount has been reserved on your credit card account, we will process your order by the delivery date.

6. Right of Revocation

You can withdraw from your order within 14 days of receiving the goods. In order to exercise your right of withdrawal, you must inform us, Leopold Pöll KG, Rechte Wienzeile 83, 1050 Vienna; E-mail: info@leposa.at, by means of a clear declaration (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract.

In the event of withdrawal, the purchase price will be reimbursed in full or in part, concurrently with the return of the goods received from the customer. The delivered products are to be returned with great care and consideration, undamaged with the label intact. LEPOSA can claim compensation if the returned goods are soiled or damaged. If the goods are not returned to us in an unused and resalable condition and in their original packaging, compensation for their value may be demanded. In the event of damage or removal of the label on the goods, we are not obliged to accept the return. When declaring the right of Revocation, the goods must be returned to the following address:

Please return the goods in their original packaging with all accessories and all packaging components. Please use a protective packaging. If you no longer have the original packaging, please use suitable packaging to provide adequate protection against damage in transportation.

7. Consequences of Revocation

If you withdraw from this contract, we will have given you all payments that we have received from you, including shipping costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us), to be repaid immediately and at the latest within 14 days from the day on which we have received the goods. For the refunding, we will use the same payment method which you have used for the original transaction. You must return or hand over the goods immediately and in any case no later than 14 days from the date on which you informed us of the withdrawal of this contract. We bear the costs of returning the goods in case of withdrawal.

8. Warranty

The guarantee is based on the statutory provisions. It is limited to the statutory period of 24 months from acceptance of the goods by the buyer. In the case of justified complaints, either a free replacement or an improvement will be made, for which a reasonable period must be allowed. If an exchange or an improvement is out of the question (not possible, too much effort, unreasonable, delayed deadline, etc.), then the buyer is entitled to a price reduction or, if the defect is not minor, to cancel the contract (conversion). Any defects that occur are to be reported as soon as possible upon delivery or after they have become visible, whereby failure to disclose this upon delivery or after a consumer has become visible has no influence on his warranty claims.

9. Privacy Policy

When initiating, concluding, processing and reversing a purchase contract, we collect, store and process data within the framework of the statutory provisions. When you visit our website, the IP address currently used by your PC, the date and time, the browser type and the operating system of your PC as well as the pages you have viewed are recorded. However, it is neither possible nor intended for us to draw conclusions about personal data. The personal data you provide to us, e.g. when placing an order or by e-mail (e.g. your name and contact details), will only be processed for correspondence with you and only for the purpose for which you have provided the data. We only pass on your data to the shipping company commissioned with the delivery, in order to deliver the goods. We assure that your personal data will not be passed on to any third parties unless we are legally obliged to do so or you have given us your consent. As far as we make use of the services of third parties to carry out processes, the provisions of the Federal Data Protection Act are complied with. Duration of storage Personal data that have been communicated to us via our website are only stored until the purpose for which they were entrusted to us has been fulfilled. As far as commercial and tax retention periods are to be observed, the duration of the storage of certain data can be up to 10 years. If you no longer agree to the storage of your personal data or if it has become incorrect, we will initiate the deletion, correction or blocking of your data in accordance with the statutory provisions. Upon request, you will receive free information about all personal data that we have stored about you. We cannot accept any liability or guarantee for the correctness or completeness of the content or the data security of links on other websites or links to third party websites. Since we have no influence on the compliance of third parties with data protection regulations, you should check the respective data protection declarations offered separately.

10. Miscellaneous

Austrian law applies to all contracts and agreements between the customer and LEPOSA. The venue for any disputes is Vienna.
